These terms (the “Terms”) govern use of the www.dalmunach.com web site including all pages, content, features and services made available through it (the “Site”).

The Site is provided by Chivas Brothers International Limited, a company registered in Scotland under company number SC646563 and with a registered office at Kilmalid, Stirling Road, Dumbarton, Scotland, G82 2SS.

By using the site, you accept these Terms

If you visit or otherwise access, use or engage with (“Use”) the Site you confirm that you understand and accept these Terms and you agree to comply with them. 

References to “you” includes any person who:

·       Uses the Site; or

·       makes available, controls or prompts an artificial intelligence (AI) or other computer system that Uses the Site. 

You are responsible for ensuring that you comply with the laws of the country in which you access the Site.

To the fullest extent permitted by law, we are not responsible for any use of the Site that is unlawful in your location.

Legal drinking age

You must be of legal drinking age in both:

• the country where you live; and
• the country from which you access the Site.

Restricted territories

If accessing the Site is unlawful where you are, you must not use it. If you are unsure, you should leave the Site and check the legal position before continuing.

You are responsible for your own internet access, equipment and any associated charges.

You are responsible for configuring your devices, software and platform to access the Site safely. You should use appropriate antivirus and security software.

We do not guarantee that the Site will be secure or free from bugs, viruses or other harmful components or security risks.

To the fullest extent permitted by law, you waive any moral rights or similar rights you may have in your User Submitted Content.

User Submitted Content must not:

• feature someone who is or appears to be under the legal drinking age;
• feature any people, shown in pictures or videos that are associated with the act of drinking alcohol, who are not, or who do not look, over 25 years old;
• encourage underage purchasing or drinking of alcoholic beverages;
• encourage illegal, irresponsible or immoderate drinking or portrays irresponsible drinking in a positive light;
• condemn or criticises anyone who chooses not to drink alcohol;
• associate drinking alcohol with driving, operating machinery or engaging in dangerous activity;
• suggest alcohol has physical, psychological, intellectual, social, sexual or performance benefits;
• suggest alcohol gives confidence, helps overcome problems or contributes to success;
• glorify high alcohol strength or the intoxicating effect of a drink; or
• link alcohol with illegal, antisocial, dangerous, aggressive or violent behaviour.

We are not obliged to monitor content on the Site, but we may review, edit, refuse to publish, delay publication or remove any User Submitted Content or other content at any time, including where we consider it unacceptable, inappropriate or in breach of these Terms.

You are solely responsible for securing and backing up any User Submitted Content you submit.

The Site may display products that you can purchase from third-party sellers, including external links or embedded purchase mechanics.  We do not sell those products through the Site and do not operate as a marketplace or agent.  Any purchase contract is between you and the relevant third-party seller and we are not a party to it.

Any purchase is subject to the third-party seller’s terms and conditions displayed at the time of purchase. Please read those terms carefully before placing an order.

We are not responsible for third-party products, services or transactions.

You will be responsible for any losses, costs, claims, liabilities or expenses we reasonably incur as a result of your breach of these Terms.

Where applicable, you should not provide personal information on public areas of the Site. If you voluntarily disclose personal information publicly, it may be accessible to others and may result in unsolicited contact.

We provide no guarantees, representations, warranties or indemnities in relation to Site content, software, services or otherwise.

Although we have taken care in preparing Site materials we cannot guarantee that:

To the extent permitted by law, we are not liable for loss or damage arising from your voluntary public disclosure of User Submitted Content. This does not affect our obligations under data protection laws.

Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation.

The Site may contain links to third-party websites and social media platforms which take you away from the Site. We do not control or endorse them and are not responsible for their content, products, services, privacy practices or terms. Your use of third-party sites and platforms is at your own risk and subject to their terms.

You may link to the Site provided you do so in a fair and lawful way that does not damage our reputation, take advantage of it, imply endorsement/relationship where none exists, make any misrepresentation about us, infringe our rights or otherwise breach applicable law.

We may withdraw linking permission at any time and without notice.

These Terms and any matter relating to the Site will be governed by Scots law and the Scottish courts shall have exclusive jurisdiction in respect of them.
